This Agreement sets forth the terms and conditions that apply to your access and use of the Internet Web site located at www.BuckeyeLifeGroup.com (“BuckeyeLifeGroup.com”), as owned and operated by Buckeye Life Group LLC, an Ohio limited liability company, on behalf of its direct or indirect subsidiaries and/or affiliates (collectively referred to as “Buckeye Life Group”). By using BuckeyeLifeGroup.com you agree to be bound by the terms and conditions of this Agreement and Buckeye Life Group’s Privacy and Security Policy, as they may be amended from time to time in the future (see “Modifications” below).

1. Accepting the Terms

By using the information, tools, features and functionality located on BuckeyeLifeGroup.com (together the “Service”), you agree to be bound by this Agreement. The term “you” or “User” refers to anyone who visits or uses BuckeyeLifeGroup.com. The term “we” refers to Buckeye Life Group.

You may not use the Service, and you may not accept this Agreement, if you are not of a legal age to form a binding contract with Buckeye Life Group.

If you accept this Agreement, you represent that you have the capacity to be bound by it or, if you are acting on behalf of a company or entity, that you have the authority to bind that entity. Before you continue, you should print or save a local copy of this Agreement for your records.

2. Privacy and Your Personal Information

For information about Buckeye Life Group’s data protection practices, please read Buckeye Life Group’s Privacy and Security Policy, which is hereby incorporated into this Agreement. The Policy explains how Buckeye Life Group treats your personal information when you access BuckeyeLifeGroup.com and use the Service. The Policy may be updated from time to time at our discretion. Changes will be effective upon posting to the site.

This website is intended to provide you with general information about our services, benefits, and features. It provides the opportunity to contact us or book a call to learn more about our services and offerings and how our services can benefit you.

The information on this website is for general educational purposes only. It is not insurance, tax, legal or financial advice, and it is not an offer or guarantee of coverage, approval, rates or results. Insurance products, features and availability vary by carrier, state and individual circumstances, and any coverage is subject to underwriting and the terms of the policy issued by the insurance company. 5. Your Use of the Service

Your right to access and use BuckeyeLifeGroup.com and the Service is personal to you and is not transferable by you to any other person or entity. You are only entitled to access and use BuckeyeLifeGroup.com for lawful purposes.

Accurate records enable Buckeye Life Group to provide the Service to you. Any information you provide to us must be true, accurate, current and complete, and you may not misrepresent the information provided. If you do not do this, the accuracy and effectiveness of the Service to you will be affected.

Your access and use of BuckeyeLifeGroup.com may be interrupted from time to time for any of several reasons, including, without limitation, the malfunction of equipment, periodic updating, maintenance, or repair of BuckeyeLifeGroup.com or other actions that Buckeye Life Group, in its sole discretion, may elect to take.

The services offered are solely life insurance-based solutions for individuals or businesses to help them meet their life insurance needs. This includes our Debt2Capital™ (D2C™) strategies, which are designed around a life insurance policy. They are not loans, debt consolidation or credit repair, and results are not guaranteed.

7. Usage Policy

You represent and warrant that if you provide contact information on this site, you do so voluntarily, with the intention of being contacted directly or sent requested information.

8. Communications

If you contact us or book a call, we may respond by email, phone or text message about your request and appointments, as described in our Privacy and Security Policy. Message and data rates may apply, and you can reply STOP to opt out of text messages at any time. By providing us with your email address, you agree to receive required notices electronically at that address, and it is your responsibility to tell us if it changes. Email and text messages are not encrypted, so please do not send sensitive information such as Social Security numbers, bank or card numbers, passwords or detailed health information by email, text or the contact form.

9. Information You Submit

By submitting information to Buckeye Life Group through the Service (such as through our contact form or scheduling page), you give Buckeye Life Group permission to use and store that information to respond to your request and provide the Service to you, as described in our Privacy and Security Policy. You represent that you are entitled to submit the information to us for this purpose.

10. Buckeye Life Group’s Intellectual Property Rights

The contents of BuckeyeLifeGroup.com, including its “look and feel” (e.g., text, graphics, images, logos and button icons), photographs, editorial content, notices, software (including html-based computer programs) and other material are protected under both United States and other applicable copyright, trademark and other laws. The contents of BuckeyeLifeGroup.com belong or are licensed to Buckeye Life Group or its software or content suppliers. Buckeye Life Group grants you the right to view and use BuckeyeLifeGroup.com subject to these terms. You may download or print a copy of information provided on BuckeyeLifeGroup.com for your personal, internal and non-commercial use only. Any distribution, reprint or electronic reproduction of any content from BuckeyeLifeGroup.com in whole or in part for any other purpose is expressly prohibited without our prior written consent.

11. Access and Interference

You agree that you will not:

  • Use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor BuckeyeLifeGroup.com or any portion of it, without Buckeye Life Group’s express written consent, which may be withheld in Buckeye Life Group’s sole discretion;
  • Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search BuckeyeLifeGroup.com, other than the search engines and search agents available through the Service and other than generally available third-party web browsers (such as Microsoft Edge);
  • Post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interferes with the proper working of BuckeyeLifeGroup.com or the Service; or
  • Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of BuckeyeLifeGroup.com or the Service.

12. Disclaimer of Representations and Warranties

THE CONTENT AND ALL SERVICES AND PRODUCTS ASSOCIATED WITH BUCKEYELIFEGROUP.COM OR PROVIDED THROUGH THE SERVICE ARE PROVIDED TO YOU ON AN “AS-IS” AND “AS AVAILABLE” BASIS. BUCKEYE LIFE GROUP MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONTENT OR OPERATION OF BUCKEYELIFEGROUP.COM OR OF THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

BUCKEYE LIFE GROUP MAKES NO REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY OR COMPLETENESS OF THE CONTENT ON BUCKEYELIFEGROUP.COM OR OF THE SERVICE, AND EXPRESSLY DISCLAIMS ANY WARRANTIES OF NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. BUCKEYE LIFE GROUP MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE THAT THE CONTENT THAT MAY BE AVAILABLE THROUGH THE SERVICE IS FREE OF INFECTION FROM ANY VIRUSES OR OTHER CODE OR COMPUTER PROGRAMMING ROUTINES THAT CONTAIN CONTAMINATING OR DESTRUCTIVE PROPERTIES OR THAT ARE INTENDED TO DAMAGE, SURREPTITIOUSLY INTERCEPT OR EXPROPRIATE ANY SYSTEM, DATA OR PERSONAL INFORMATION.

13. Limitation of Buckeye Life Group’s Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUCKEYE LIFE GROUP SHALL NOT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO BUCKEYELIFEGROUP.COM, YOUR USE OF THE SERVICE OR THIS AGREEMENT, EVEN IF BUCKEYE LIFE GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Your Representations and Indemnification of Buckeye Life Group

You warrant and represent to Buckeye Life Group that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and that you will comply with all applicable laws, rules and regulations with regard to your use of BuckeyeLifeGroup.com and the Service.

You agree to defend, indemnify and hold harmless Buckeye Life Group and its affiliates and each of their respective officers, employees, agents, contractors, representatives and service providers from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of this Agreement or your unlawful use of BuckeyeLifeGroup.com or the Service. You agree to cooperate as reasonably required in the defense of any such claim, and we reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

15. Modifications

Buckeye Life Group may modify this Agreement from time to time. Any and all changes to this Agreement will be posted on the BuckeyeLifeGroup.com site. In addition, the Agreement will always indicate the date it was last revised. You are deemed to accept and agree to be bound by any changes to the Agreement when you use the Service after those changes are posted.

16. Governing Law and Forum for Disputes

This Agreement, and your relationship with Buckeye Life Group under this Agreement, shall be governed by the laws of the State of Ohio without regard to its conflict or choice of laws provisions. Any dispute with Buckeye Life Group, or its officers, employees, agents or affiliates, arising under or in relation to this Agreement shall be resolved in the state or federal courts located in or serving Allen County, Ohio, except with respect to imminent harm requiring temporary or preliminary injunctive relief, in which case Buckeye Life Group may seek such relief in any court with jurisdiction over the parties.

17. Miscellaneous

If any portion of this Agreement is deemed unlawful, void or unenforceable by any court of competent jurisdiction, this Agreement as a whole shall not be deemed unlawful, void or unenforceable, but only that portion of this Agreement that is unlawful, void or unenforceable shall be stricken from this Agreement.

You agree that if Buckeye Life Group does not exercise or enforce any legal right or remedy which is contained in the Agreement (or which Buckeye Life Group has the benefit of under any applicable law), this will not be taken to be a formal waiver of Buckeye Life Group’s rights and that those rights or remedies will still be available to Buckeye Life Group.

All covenants, agreements, representations, and warranties made in this Agreement shall survive your acceptance of this Agreement and the termination of this Agreement.

This Agreement represents the entire understanding and agreement between you and Buckeye Life Group regarding the subject matter of the same and supersedes all other previous agreements.
